These Terms of Service (“Terms”) govern your use of this website and the purchase of products trading as Draigwyn Tales (“we”, “us”, “our”).

By accessing this website or placing an order, you agree to be legally bound by these Terms.

We operate as a sole trader in the United Kingdom.


2. Formation of Contract

2.1 All orders placed through the website constitute an offer to purchase goods.

2.2 An order confirmation email acknowledges receipt of your order but does not constitute acceptance.

2.3 A legally binding contract is formed only when we dispatch the goods.

2.4 We reserve the right to refuse, cancel, or limit any order at our sole discretion, including (but not limited to):

  • Suspected fraudulent activity
  • Payment authorisation failure
  • Pricing or listing errors
  • Abuse of discount codes
  • Bulk purchasing inconsistent with personal consumer use

If payment has been taken for a cancelled order, a full refund will be issued.


3. Products & Made-to-Order Items

3.1 All products are printed to order using original designs.

3.2 Due to screen differences, we do not guarantee exact colour accuracy.

3.3 Minor variations in print placement, colour tone, or garment shade do not constitute defects.

3.4 All measurements are approximate and subject to manufacturing tolerances.


4. Pricing & Payment

4.1 All prices are displayed in GBP (£).

4.2 We reserve the right to amend pricing at any time without notice.

4.3 If a pricing error is identified after an order is placed, we are not obliged to supply the product at the incorrect price.

4.4 Payment must be received in full before production begins.


5. Cancellations

5.1 Orders may only be cancelled within 2 hours of placement.

5.2 After this period, production may have commenced and cancellation is no longer possible.

5.3 Under the Consumer Contracts Regulations 2013, goods made to order are exempt from the 14-day cancellation right.


6. Delivery & Risk

6.1 Delivery timeframes are estimates only and are not guaranteed.

6.2 We are not liable for delays caused by postal services, customs, or circumstances outside our reasonable control.

6.3 Risk in the goods passes to you upon confirmed delivery to the address provided at checkout.

6.4 Customers are responsible for providing accurate delivery information. We are not liable for losses caused by incorrect addresses.


7. Returns & Statutory Rights

7.1 Due to the made-to-order nature of our products, we do not accept returns for change of mind, incorrect sizing, or preference.

7.2 Nothing in these Terms excludes your statutory rights under the Consumer Rights Act 2015.

7.3 If goods are faulty, damaged, or not as described, you must notify us within 14 days of delivery with photographic evidence.

7.4 We reserve the right to inspect returned goods before issuing a refund or replacement.


8. Intellectual Property

8.1 All designs, artwork, graphics, branding, and website content are the exclusive intellectual property of Draigwyn Tales.

8.2 Unauthorised reproduction, resale, modification, or commercial exploitation is strictly prohibited.

8.3 We reserve the right to pursue legal action for infringement.


9. Chargebacks & Payment Disputes

9.1 Customers agree to contact us directly to resolve any issue before initiating a chargeback or payment dispute.

9.2 Fraudulent chargebacks may be pursued as civil debt recovery and reported to relevant authorities.

9.3 We reserve the right to provide order data, delivery confirmation, and correspondence to payment processors to contest disputes.

(This clause doesn’t stop chargebacks — but it strengthens your defence case.)


10. Limitation of Liability

10.1 To the fullest extent permitted by law, we shall not be liable for:

  • Indirect or consequential losses
  • Loss of profit, revenue, or business opportunity
  • Delays outside our reasonable control

10.2 Our total liability shall not exceed the purchase price of the goods.

10.3 Nothing in these Terms limits liability for:

  • Death or personal injury caused by negligence
  • Fraud or fraudulent misrepresentation
  • Any matter which cannot legally be limited under UK law

11. Force Majeure

We are not liable for failure to perform obligations due to events beyond our reasonable control, including but not limited to:

  • Postal disruption
  • Supply chain shortages
  • Natural disasters
  • Government restrictions

12. Governing Law

These Terms are governed by the laws of England and Wales.

Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
